A woman calls in saying she wants to apply for indefinite stay and her lawyer told her that as you have a child and you claim benefit, you cant take it. My husband was born here and is British. Harjap says what is your status, did you come on a marriage visa. She says yes. Harjap says when does it end? She says the visa I got finishes on 9th March and I came on 30th March. Harjap says you can apply; you can take child benefit, child tax credit and working tax credit. There is a regulation that says that for marriage cases, these 3 benefits are exempt so there is no problem. She says she is from Glasgow and she came here via an appeal as there was a problem with the case. Harjap says the advice your lawyer is giving you is wrong. She says he also said that for my house, I need bills on my name and me and my husband used to live in one house and added the name on. Harjap says you must have something with your name on such as a doctors card and bank statements. She says I do have them but on my husbands name. He has added my name on some documents but I was told I need bills from the last 2 years. Harjap says usually you need 10 documents from the last 2 years, 10 on your name or on your husbands name. You need something for that period, not from something like 2 months. She says I dont have that or any combined account.
